Who can make a whiplash claim?
Anyone who has suffered a whiplash injury in an accident that was not their fault can make a claim. This includes drivers, passengers, motorcyclists, cyclists and pedestrians. Even if you were a passenger in a vehicle driven by a friend or family member, you are still entitled to claim against the at-fault party's insurer.
How much compensation can I claim for whiplash?
It depends on how severe your injury is, how long your recovery takes, and any financial losses such as lost earnings or treatment costs. Minor injuries that resolve within a few months usually attract lower awards, while more serious injuries with lasting symptoms can be worth significantly more. How long do I have to make a claim?
In Scotland, most personal injury claims must be started within three years of the date of the accident. This deadline is set by the Prescription and Limitation (Scotland) Act 1973 and, with very few exceptions, missing it means losing your right to claim. Contact us as soon as you are able.
